New Concerns

In 2005, the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) became law.  The effect it has on Chapter 7 bankruptcy laws is significant, and was brought forth by banks and other institutions seeking to eliminate issues with consumers who file abusively under Chapter 7 bankruptcy laws.  Under the new laws, it now appears to be more difficult for individuals to file for Chapter 7 – a move which has been criticized by some, and encouraged by others.
